Resumo
Based on the undoubted public nature of public urban facilities, the difference between the figures of the public concession and the concessions regulated by Law 9/2017, of november, of Public Sector Contracts, is analysed, to reach the conclusion that that it will be necessary to be at the typical traffic of the Administration to differentiate one from the other. Only the latter will have a contractual nature, while the first must be considered unilateral administrative acts, albeit of a receptive nature.
