Abstract
The significance of the country‐of‐origin principle concerning copyright applicable to satellite broadcasting and cable retransmission, under Directive 93/83/EEC, is discussed in connection with the judgment of the Court of Justice of 25 May 2023 in AKM (Fourniture de bouquets satellitaires en Autriche). The implications of the exclusion of copyright from the country‐of‐origin principle under the E‐commerce Directive and its interplay with the new Digital Services Act is also examined in the light of recent practice of the Court of Justice.
