Resumo
The judge Michele Emiliano case, recently submitted to the scrutiny of the Constitutional Court and judged in case 170/2018, still leaves several unresolved issues about the currently uphold ban on judges from enlistment and continuous and systematic participation to political party activities. Some of those issues are subject to consideration in this article.
