Zusammenfassung

The Directive (EU) 2022/2041 of the European Parliament and of the Council of 19 October 2022 on adequate minimum wages in the European Un-ion culminates a long legislative process with an outcome that has more political than legal impact. It is a sign of progress towards the social construction of Europe, but the limitation of the legal basis - derived from the express prohibition of the founding treaties to regulate wages - greatly limits the potential effective impact. This paper analyses this problem and how it led to the text finally published in the Offi-cial Journal, and then goes on to analyse its content. This analysis is carried out from an application perspective to the Spanish social legal system, highlighting the aspects in which an adaptation of domestic law will be necessary. These are not particularly complex, but they may have a significant impact both on transparency in the setting of the minimum wage and on the preparation and availability of data in general. It will also be necessary to involve the social partners more closely. The greatest diffi-culty arises in the weighting of each of the criteria used to set the minimum wage and its updating; also in some cases, such as employment in the personal and house-holds services, deductions may raise problems of indirect discrimination in terms of social security contributions
