Abstract

This brief essay is an analysis of the mechanism of exoneration of corporate responsibility in matters of Social Security provided for in article 42 of the Workers’ Statute. After exposing the interpretation that has been prevailing of the precept, it addresses the new doctrine established in this regard by the Contentious-Administrative Chamber of the Supreme Court, of which a critical analysis is made. In the opinion of its author, this interpretation has emptied the precept of content, ignoring its tenor and functionality. This makes its legal reform necessary in the context of a new general labor regulation of the outsourcing
