Zusammenfassung

The growing phenomenon of outsourcing challenges the traditional structure of collective bargaining. Often, when an activity is outsourced, employ ees have different conditions if they had been hired directly by the main company, or even renain without a collective agreement. For this reason, a doctrinal and judicial debate was opened some time ago on the collective agreement applicable to employees in service or multiservice companies. And more recently, RD-Law 32/2021 has come to specifically regulate this matter, amending art. 42 of the Employees’ Statute. For all these reasons, this article deals the judicial treatment of the issue and the changes introduced in this respect by the 2021 reform, which confirm the latest case law of the Supreme Court
