Zusammenfassung
The modifications introduced by Law 16/2022 encourage the revision of the exercise of the corporate action to demand liability against the administrators of an insolvent company. Article 132 LC (Insolvency Act) attributes to the receivership the exercise of the action. The article analyzes the different scenarios in which the receivership can exercise this power, in ordinary insolvency proceedings, in insolvency proceedings without assets or in special insolvency proceedings.
