Abstract

This work analyzes a recent case-law of the Supreme Court where it judges the validity of a territorial planning plan approved by the Autonomous Community of Valencia to protect the environment. In this matter, it was judged that in the processing of this plan, its social and environmental impacts and its economic viability had been taken into account. The Supreme Court concludes that the plan is legal by judging the reports issued on these aspects to be adequate, considering their assessment in light of the principle of proportionality
